Echo App Labs, LLC (“Echo,” “we,” “us”) respects the intellectual property rights of others and expects users to do the same. We respond to notices of alleged copyright infringement that comply with the Digital Millennium Copyright Act (“DMCA”), 17 U.S.C. § 512.

Filing a takedown notice

If you believe content on Echo infringes your copyright, send a written notice to our designated agent (below) that includes:

• A physical or electronic signature of the copyright owner or someone authorized to act on their behalf.
• Identification of the copyrighted work claimed to have been infringed.
• Identification of the material you claim is infringing, and information reasonably sufficient to let us locate it — for Echo, that generally means the post or comment ID, a link or screenshot, and the approximate date/time you saw it, since content isn't tied to a real-name account.
• Your contact information: name, address, telephone number, and email address.
• A statement that you have a good-faith belief the use is not authorized by the copyright owner, its agent, or the law.
• A statement, made under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on their behalf.

Notices missing any of the above may not be actionable under the DMCA and can delay processing.

What happens after a valid notice

We remove or disable access to material identified in a valid notice, generally without first notifying the poster given Echo's anonymous, ephemeral content model. Repeat infringers — accounts subject to multiple valid takedown notices — are subject to suspension or a permanent ban at our discretion.

Filing a counter-notice

If you believe your content was removed by mistake or misidentification, you may submit a counter-notice to the same address including:

• Your physical or electronic signature.
• Identification of the material that was removed and where it appeared before removal.
• A statement, under penalty of perjury, that you have a good-faith belief the material was removed as a result of mistake or misidentification.
• Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if outside the U.S., any judicial district in which we may be found), and that you will accept service of process from the person who filed the original notice.

Upon receiving a valid counter-notice, we may reinstate the material in 10–14 business days unless the original complainant notifies us that they've filed a court action seeking to restrain the alleged infringer.

Misrepresentation

Under 17 U.S.C. § 512(f), anyone who knowingly materially misrepresents that material is infringing, or was removed by mistake, may be liable for damages, including costs and attorneys' fees.
